Scans compared with paper originals
A scanned PDF of a paper document is an electronic document and can be notarized electronically. The paper original itself stays under the 2004 Notarial Rules.

The Rules define an electronic document to include scanned copies of paper documents, and limit electronic documents to PDF or PDF/A. (Rule I, Section 4(d))
Paper documents and instruments with handwritten signatures or marks are still governed by the 2004 Rules on Notarial Practice. (Rule I, Section 2) The Rules on Electronic Notarization do not apply to them. (Rule I, Section 5)
In practice
- Upload a scanned PDF if you want it electronically notarized.
- If the act is a jurat, sign electronically in front of the ENP rather than scanning a pre-signed page. (Rule IV, Section 3)
- For acknowledgments, affirmations, and oaths, a pre-signed document is allowed. The principal confirms the signature is theirs. (Rule IV, Sections 1(b) and 2(b))
- To notarize the paper original itself, go to a notary public under the 2004 Rules.
